Data Privacy relating to our Business - Valuation Services

We currently collect and process the following information

  • Personal identifiers, contacts and characteristics (e.g name and contact details)

  • Email addresses

  • Telephone numbers

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • Contact details of who has instructed us for a valuation and any relevant authority

  • Address of the property where items are located that are the subject of the valuation

  • Name and contact address of the recipients of our valuation, if different to the instructing client. This may be a professional estate administrator or a private individual . Valuations are sent via email in Protected PDF format.

  • Email address from any enquiry to our website.

  • Bank account details to facilitate payment of auction house proceeds where applicable.

  • (N.B). Toby Pinn Ltd does not hold client money at any stage of the business relationship with our clients.

We also receive personal information indirectly, from the following sources in the following scenario’s

  • During the valuation process we are collecting data relating to personal property. This may be for property relating to a the deceased for a probate valuation, or a living person for example an insurance valuation.

  • Beneficiary names, if we are asked to identify gifts within the estate and ascribe them to a named recipient this data forms part of the valuation.

We use the information that you have given us in order to

  • Contact you to arrange a valuation visit

  • Discuss any aspect of the valuation

  • Attend the valuation

  • Send our valuation

  • Follow-up on any aspect of the valuation including our post-valuation services

We may share this information with the following third parties

  • The Royal Institution of Chartered Surveyors (RICS). The files of all RICS Regulated firms and Registered Valuers may be subject to monitoring under the institutions conduct and disciplinary regulations.

  • Removal Firms - Where we receive instructions to arrange the removal of items from a property, the necessary valuation data may be shared with a removal firm in order for them to carry out their instructions and to ensure that the items being moved are adequately insured.

  • House Clearance Firms - Where we receive instructions to arrange the removal of all remaining items from a house for ‘Vacant Possession’ we will need to share a limited amount of data for that purpose and to provide access.

  • Auction Houses - Where we receive instructions to arrange the sale of items through an auction house, we will be required to share your data to allow the auction house to comply with Anti-Money Laundering requirements, process the sale and forward sale proceeds to the appropriate recipient either by post (cheque) or bank transfer.

Under the General Data Protection Regulation (GDPR), the lawful basis we rely on for processing this information are

How we store your personal information.

Your information is secured stored electronically in encrypted format at a secure location and with a corresponding cloud-based encypted back-up.

We keep your data as described above, including valuation data for seven years. Our recommended maximum interval between insurance valuations is five years and we automatically notify you after five years have elapsed, providing two years grace before we delete the data. All electronic data is deleted in accordance with recognised approved procedure.

Your right to rectification - You have the right to ask us to rectify personal information you think is in accurate. You also have the right to ask us to complete information you think is incomplete.
